Method of Purchase

Purchases can be concluded through our website. All prices displayed on the website are inclusive of VAT.

Shipping and Delivery Methods

We ship in Italy by courier. The goods are always accompanied by the relevant invoice inside the package. For Italy, delivery times are 2 to 3 working days for goods readily available in our warehouses, while for goods not in stock delivery time varies according to the availability of the items ordered.

General Terms of Sales

Agreement governing online purchases between Gruppo Editoriale Volontè & Co and the customer.

  1. LIABILITY

Gruppo Editoriale Volontè & Co. shall not be held liable for disservices ascribable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and similar events which might fully or partially impact the execution of the purchase agreement within the established timeframe. Volontè & Co. shall also hold no liability towards any party for damages, losses and costs resulting from the non-execution of the purchase agreement due to the above-mentioned causes, as well as any damage, loss or cost derived by the use or the impossibility to use the purchased products, reserving to the customer the sole right of reimbursement of the purchase cost, excluding any shipping cost. Likewise, Volontè & Co. is not responsible for any fraudulent or illegal use credit cards, checks and other means of payment that may be done by third parties when paying for the purchased products.

  1. OBLIGATIONS OF THE BUYER

Once the online purchase procedure has been completed, the customer commits to print and/or keep these general terms and conditions, which additionally they will have already viewed and accepted as a mandatory step in the purchase process, as well as to print the specifications of the product purchased, in order to fully satisfy the condition set out in Articles 3 and 4 of Legislative Decree 185/99.

The purchaser is strictly prohibited from entering false and/or invented and/or fictitious data in the registration procedure they need to complete to initiate for them the procedure for the execution of this purchase agreement and any further communications related to it; the personal data and e-mail address must be exclusively the real personal data and not those of third parties.

  1. AUTHORIZATIONS

If the customer chooses to use the credit card payment method by filling in the appropriate fields on our website, they authorize Volontè & Co. to use their credit card and to debit their bank account for the total amount shown as the cost of the purchase in favour of the aforementioned company. The entire procedure is carried out via a secure connection directly linked to banking institute owning and managing the online payment service, which Volontè & Co. cannot access.

  1. CONTRACTUAL TERMINATION AND EXPRESS TERMINATION CLAUSE

The obligations assumed by the customer in Art.2 above (Obligations of the buyer), as well as the confirmation of successful completion of the payment made by the customer, are essential, as in accordance with the stated agreement, the failure by the Customer to comply with any one of these obligations will result in the legal termination of the contract pursuant to Art. 1456 of the civil code, without the need for a court ruling, notwithstanding the right of Volontè & Co. to take legal action for compensation of further damage.

  1. COMPETENT COURT AND JURISTICTION

Any dispute relating to the application, execution, interpretation, and breach of the online purchase agreement obtained through the website www.edizionicarrara.it is subject to Italian jurisdiction; these general terms and conditions refer, for anything not expressly provided herein, to the combined provisions of Legislative Decree 50/92 and Legislative Decree 185/99.

The Court of Milan shall have exclusive jurisdiction over any dispute between the parties concerning the present contract.

Privacy

PURPOSE OF THE PROCESSING OF COLLECTED DATA

The data provided are processed, as part of our company’s normal business activities, in accordance with Article 10 of Law 675/96 on the “protection of persons and other subjects in regard to the processing of personal data”, for the following purposes:

1) purposes strictly connected and instrumental to the management of relations with the compiler (internal statistics, approval feedback, preliminary acquisition of information aimed at the conclusion of a contract or the provision of a service, etc.);

2) purposes related to obligations under applicable laws;

3) purposes functional to the business of this company.

4) transmission of commercial communications.

This is not prejudicial to the user’s right to exercise their rights under Article 13 of Law 675/96.
